Terms of Service

1. Agreement to Terms
These Terms of Service (“Terms”) form a binding agreement between you and the business you represent (“you,” “Customer”) and FieldSupe (“FieldSupe,” “we,” “us”) governing your access to and use of the FieldSupe platform, websites, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
FieldSupe provides software for managing field-service operations, including customer records, scheduling and dispatch, job management, invoicing and payments, inventory, employee management, and related analytics and AI-assisted features. We may add, modify, or remove features over time.
3. Accounts and Eligibility
You must provide accurate information when creating an account and keep it current. You are responsible for safeguarding your credentials and for all activity under your account. You must be authorized to bind the business you register and be at least 18 years old. Notify us promptly of any unauthorized use.
4. Subscriptions, Fees, and Payment
Paid plans are billed in advance on a recurring basis (monthly or as otherwise stated at checkout) through our payment processor. Fees are non-refundable except where required by law. We may change pricing on prospective renewal terms with reasonable notice. If a payment fails, we may suspend or downgrade access until the balance is resolved. You authorize us and our processor to charge your payment method for applicable fees and taxes.
Where the Service facilitates payments from your customers to you, you are solely responsible for the accuracy of invoices, applicable taxes, and compliance with the payment processor’s terms. Processing fees may apply.
5. Acceptable Use
You agree not to: (a) use the Service unlawfully or to infringe others’ rights; (b) attempt to gain unauthorized access to the Service or other customers’ data; (c) interfere with or disrupt the integrity or performance of the Service; (d) reverse engineer the Service except as permitted by law; or (e) use the Service to send unsolicited or unlawful communications.
6. Your Data
You retain ownership of the data you submit (“Customer Data”). You grant us a limited license to host, process, and transmit Customer Data solely to provide and improve the Service and as described in our Privacy Policy. You are responsible for the lawfulness of Customer Data and for obtaining any required consents from your own customers.
7. AI Features
Certain features use artificial intelligence to generate insights, drafts, and recommendations. AI output may be inaccurate or incomplete and is provided for assistance only; you are responsible for reviewing it before relying on it. Do not treat AI output as professional, legal, or financial advice.
8. Third-Party Services
The Service integrates with third-party providers (for example, payment processing, email/SMS delivery, and mapping). Your use of those integrations may be subject to the third party’s terms, and we are not responsible for their acts or omissions.
9. Intellectual Property
The Service, including its software, design, and content (excluding Customer Data), is owned by FieldSupe and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.
10. Termination
You may cancel at any time; cancellation takes effect at the end of the current billing period. We may suspend or terminate access for breach of these Terms or non-payment. Upon termination, your right to use the Service ends. We will make Customer Data available for export for a reasonable period after termination, after which we may delete it.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDSUPE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You will indemnify and hold FieldSupe harmless from claims arising out of your Customer Data, your use of the Service, or your breach of these Terms, except to the extent caused by our gross negligence or willful misconduct.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in-app). Continued use after changes take effect constitutes acceptance.
